Building a center for the illegal aliens to solicit work would violate several laws, and further erode the quality of life in that neighborhood. I am deeply concerned about what kind of message we are sending to our youth when they pass government sanctioned areas of illegal activity on their way to school. Some areas of specific concern are: 1) Are the homeowners who hire these criminal aliens withholding for federal and state income tax, as well as securing workman’s compensation? 2) The local licensed contractors who hire these illegal aliens are violating several sections of the Federal Labor Code against whom action can be initiated by the Division of Labor Standards Enforcement. Who will follow up to ensure these unscrupulous contractors are punished? 3) Anyone who is hired for work is required to have a Social Security Number and hiring someone without a SSN is illegal. Are the contractors and home owners checking for Social Security Numbers? Are withholdings being sent to the government? 4) Are the proper city permits being pulled to ensure the work is being performed according to local building, safety, and earthquake codes? 5) Any unlicensed contractor who performs any kind of construction work is required to have a Contractors License after the aggregate total work done exceeds $300. Who is ensuring that this is done? 6) Anyone who pays an illegal alien for work is Aiding and Abetting this illegal activity. Who will enforce these laws? I would like you to know Councilwoman Miscikowski, that these issues affect me very personally. I am a local businessman with a State Contractors License, and I find it difficult to compete with other contractors who hire illegals and don’t pay workman’s compensation insurance, state or federal tax, social security and otherwise violate the labor code to increase their personal profit. These labor codes were written for a very good reason, they protect our working families and children from unscrupulous and unsafe business practices. These illegals take money right out of my pocket by taking away my work, they cost me money in additional taxes that I pay and they do not.. I am horrified that you propose to actually set up centers to promote this illegal and family destructive activity. This illegal ‘labor camp’ is just down the street from Webster Junior High School and is certain to present a sorry example for our community’s school children. I would very much like to arrange a meeting with you in regards to the above concerns. I want to participate in any public hearings on these issues. I would like the opportunity to address the city council in person. If necessary, I intend to request permission to sue the city, as I can show in very real ways how this activity has harmed me and my family both financially and in the loss of our quality of life.
